Deathbed Gifts - How to Make a Valid Donatio Mortis Causa
Introduction
This new virtual classroom seminar will examine the thorny issue of deathbed gifts and the requirements for making a valid donatio mortis causa (‘DMC’).
The session will consider each of the requirements for a DMC and the applicability of the principle to particular types of gifts including registered and unregistered land.
Consideration will be given to the leading authority of King v Dubrey as well as the recent decisions in Davey v Bailey and Rahman v Hassan.
The session will be useful not only for private client litigators but also for those who deal with estate administration to know what to look for when a DMC is alleged.
