Introduction

The regulation of mortgages and secured lending is covered by the provisions of the Financial Services and Markets Act 2000 (‘FSMA’). Join Simon Popplewell who will look at which types of secured lending fall within the FSMA regime, and how to avoid regulation if at all possible.

This virtual classroom session will also consider issues such as loans to family members to assist in the purchase of property, and whether such loans require FSMA authorisation, as well more traditional arms length types of secured loans. It will discuss what consequences apply if a mortgage or secured loan does fall within the FSMA regime and also consider other legislation other than FSMA that might impact on secured lending.
