Introduction

Detection and prevention of antitrust/competition law violations are the primary focus of compliance programmes. The purpose of a good compliance programme is to ensure that a company operates according to ethical standards. A credible compliance programme is a risk management tool that helps a company achieve this goal.

This virtual classroom session is aimed at those advising on competition or antitrust compliance programmes, designing them for their clients or advising clients on how to update them and the legal implications and effects in the UK and Europe.

What You Will Learn

This live and interactive session will cover the following:

  • Legal impact of having a competition or antitrust compliance programme - different approaches from the EU and the UK and when compliance programmes as a mitigating factor in infringement cases
  • Tailoring the compliance programme to each business - depending on the nature of its business, the competitive risks it faces and the sector in which it operates
  • The core set of elements required in an effective compliance programme
    • Management commitment - how to get it and what is useful in terms of clear and public statements about strict compliance with competition law and its importance
    • Appointing a competition compliance contact - appointing a person with responsibility for proper implementation of compliance and more generally the policy
    • Training and updating - the need for the implementation of awareness-raising, information and training actions for all staff
    • Policy documents
    • Control, audit and warning mechanisms
