Introduction

There have been several cases in which an accused person has faced a murder charge in circumstances where the cause of death was unascertained. On those occasions the cumulative effect of circumstantial evidence was said to have been capable of yielding an irresistible inference that the accused has murdered the deceased.

Evidence such as, aspects of the accused’s position which are contradicted by other evidence (thereby allowing the inference that the accused’s position is demonstrably untrue), soil evidence, forensic techniques establishing the presence of blood and so on. In the last few years, such issues have been addressed in appeals against conviction.

This webinar is from a Scottish criminal law perspective but many of the issues covered will also be applicable across the UK.
