Introduction
The Insolvency Act 1986 now contains several different provisions which restrict the ability of suppliers into insolvent companies to demand ransom payments or to rely upon contractual provisions permitting termination on the grounds of insolvency (so-called ‘ipso facto’ clauses).
This short webinar will look at sections 233, 233A and 233B of the Insolvency Act 1986 and how they impact suppliers of insolvent companies.
The webinar will focus on the newest provision, s233B, which extends the restrictions on ‘ipso facto’ clauses to all suppliers of goods and services, together with the available exemptions and safeguards.
It will also consider the various ways in which suppliers can look to improve their position, including drafting and practical steps.
