Introduction

Family lawyers are often concerned about the implications of costs orders being made within proceedings and this webinar will provide a helpful oversight of the current position on costs within family proceedings.

29 April 2024 saw a significant update to the Family Procedure Rules, which resulted in a major shift in the landscape in family proceedings. This includes an indication that the court will impose tougher sanctions on failure to attempt out of court resolution and being more prepared to make costs orders.

This webinar will provide practical guidance on the processes to follow to reduce the risk of costs orders, as well as providing an update on recent court decisions and precedents around costs orders.

What You Will Learn

This webinar will cover the following:

  • The key requirements under the Family Procedure (Amendment No. 2) Rule 2023, and how this could relate to an order for costs
  • Guidance from the case of OG v AG
  • Subsequent decisions since OG v AV and the current position following recent case decisions on costs, including X v Y, Traharne v Limb and HO v TL [2024]
  • Best practice to reduce the risks of vulnerability to costs orders

This pre-recorded webinar will be available to view from Monday 17th February 2025
