Introduction

Increasingly, financial investigators are alleging the existence of hidden assets and tainted gifts in Confiscation cases. This creates major issues for defendants because they have to prove that these potentially available assets do not exist. Often the hidden assets are alleged because the Prosecution are unable to identify the final destination of monies. This is particularly true when crypto assets are involved.

What You Will Learn

This live and interactive session will cover the following:

  • Ideas on how to defend hidden assets allegations
  • When is a tainted gift not a tainted gift?
  • Identifying double counting in the Prosecution’s Section 16 statement
  • When to instruct a forensic accountant and what a forensic accounting expert can offer in POCA cases
  • A brief understanding of crypto currency and its impact on POCA cases
  • Considerations when defending crypto hidden assets
  • Navigating negotiations with the Prosecution

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
