Introduction

Equitable accounting is a phrase to strike fear into many practitioners who are otherwise confident in dealing with property disputes between unmarried couples and co-owners. It is a subject that is shrouded in mystery for many. Very often, questions of equitable accounting are not properly considered until the end of a case. However, the process has the power to transform how much money individuals walk away with from legal disputes holding, for good or ill. There is widespread nervousness about how to approach it and what to expect from a court adjudicating on it.

This virtual classroom seminar aims to tackle those issues and equip solicitors, barristers and other legal professionals to deal confidently with ‘the books’ as between co-owners.

What You Will Learn

This live and interactive course will cover the following:

  • Popular myths debunked: what do parties most often get wrong about equitable accounting?
  • The legal framework around equitable accounting as a general subject with a ‘run down’ of the important historic cases and worked examples to show how the principles can radically alter what happens in a case
  • How to approach occupation rent and section 13 of TLATA, with a worked example
  • How to approach accounting for improvements and other increases in value, with a worked example
  • Pitfalls to look out for and practical tips for everyday cases

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
