Introduction

The Housing and Planning Act 2016 introduced a range of measures designed to ‘crack down on rogue landlords’ in the privately rented housing sector. One of these measures was the introduction of civil penalties up to £30,000 as an alternative to prosecution for certain specified offences.

Despite their introduction a number of years ago, there is still uncertainty around civil penalties, when they can be used and what happens if they are appealed.

The aim of this webinar is to provide clarification by reference to the relevant legislation and case law. The webinar is suitable for legal representatives and anyone involved in housing standards enforcement who want to learn more about housing civil financial penalty notices and appeals.

What You Will Learn

This webinar will cover the following:

  • The offences in relation to which civil penalties can be imposed as alternative to conviction
  • The procedure in relation to imposing civil penalty notices, including the importance of policy, both national and local
  • What happens when a penalty notice is appealed to the First-Tier Tribunal, including:
    • The bases for appeal, including reasonable excuse, liability and quantum
    • The procedure from the appeal notice through to the final hearing
    • The approach adopted by the Tribunal at the final appeal hearing

This pre-recorded webinar will be available to view from Tuesday 10th June 2025
