Introduction

In all financial remedy cases, the court must look beyond strictly property assets, businesses and bank accounts and consider ‘other financial resources which each of the parties to the marriage has or is likely to have in the foreseeable future’ (section 25(2)(a), Matrimonial Causes Act 1973 (MCA 1973)).

This webinar provides an overview as to the variety of trusts that often appear in financial remedy cases. It will give insight into the considerations that the court will have for these, as well as any potential orders that can be made.

What You Will Learn

This webinar will cover the following:

  • Overview of the main different types of trusts
  • Example of the orders that the court make regarding discretionary trust assets
  • Overview of considerations for the issue of disclosure and joinder applications
  • Overview of invalid and sham trusts
  • Top tips and practical guidance

This pre-recorded webinar will be available to view from Monday 6th October 2025
