A lender may well find that obtaining judgment for a debt is only the start of a much lengthier procedure for enforcing payment of that debt. Such a lender will often consider insolvency proceedings as a tool in their arsenal for enforcing such a judgment.

Should that tool be thought of as a last resort after all other measures have failed? Or should it be deployed early as a means to force a debtor to pay up, or at least to the negotiating table?

From a debtor’s perspective, can the tables be turned on an over hasty creditor?

As is so often the case, the answer to these questions is fact-specific or to put it another way, it depends. This virtual classroom seminar will provide an introduction to the considerations which are likely to be relevant in insolvency and debt matters.
