Introduction

The legal issues created by the growing uses of AI technologies and generative AI tools pervade several areas of law.

The continuing growth and expansion of AI tools has promoted policy debates and legislative initiatives aimed at regulating the use of AI and creating a legal framework that balances the interests of various stakeholders.

Certain jurisdictions, such as the EU, have already taken legislative steps to create a legal framework to regulate the use of AI technologies.

However, many legal questions remain unanswered, particularly in the field of copyright, where the training of AI models and use of AI tools present a host of challenges regarding the subsistence, authorship, ownership, and infringement of copyright.

Some of these challenges may be met through policy changes and legislative measures, whilst other challenges will be left to the courts to develop progressively as technologies continue to evolve and advance.
