Introduction

Instances of coercive control are on the rise.

There have been high profile cases in recent times which highlight the importance of the role of professional advisers or those working with vulnerable people in identifying and protecting the vulnerable client against it.

This new virtual classroom seminar will explore the estate planning tools at a professional’s disposal where coercive control is suspected and will enhance your competence in knowing how to deal with the issue in practical terms to prevent financial abuse.

It will also offer insights into the scope for law reform in this area.

The session is suitable for private client solicitors and litigators, financial advisers, wealth managers, attorneys, trustees and charities whose work centres on the elderly or vulnerable, and all those involved in estate planning work or legal advice for the elderly or vulnerable.

What You Will Learn

This live and interactive course will cover the following:

  • How to identify a vulnerable client
  • What is coercive control and how is it different from undue influence?
  • The statutory framework for coercive control and how it is prosecuted
  • What estate planning tools can assist where coercive control is suspected?
  • How far does a professional’s duty extend when on notice of coercive control?
  • The developing law on predatory marriage - the current challenges, remedies and routes to reform
