The contract of employment is the crucial document that records the agreed terms between the employer and the employee. However, it is also important to note that there are implied terms and incorporated terms, in addition to the express terms covered in the written document.

Change is a feature of many organisations, and that can mean that an organisation wants to vary a contract of employment. To avoid a breach of contract claim, this must be managed fairly.
