Orders under 91(14) of the Children Act 1989 & the Impact of the Domestic Abuse Act 2021
Introduction
Family law practitioners will be acutely aware that domestic abuse can take a variety of forms. The impact of domestic abuse on the victim is widely understood. Practitioners will also be aware of Practice Direction 12J and the impact that domestic abuse can have on a child/children when they witness domestic abuse or their parents are the victim.
Section 91 (14) of the Children Act 1989 (CA 1989) allows the court to make a protective order that prevents a named person from making any application under the CA 1989 in relation to a child without the court’s permission. This effectively acts as a protective filter.
The DDA 2021 brought in a new section 91A of the CA 1989 as well as Practice Direction 12Q. This webinar will consider how s91A and PD12Q have settled into the family law ecosystem as well as providing an overview of the recent cases of P v F [2023] and F v M (REV) [2023].
