Introduction

This new virtual classroom seminar will examine what is required for a claim under s.423 Insolvency Act and covers the recent decisions in Invest Bank v El-Husseiny and Purkiss v Kennedy which expand and delineate the scope and purpose of the legislation.

The session is not just for insolvency litigators, but also those involved in fraud litigation looking for ways in which to maximise recoveries.

The session includes a case study on a real example of a hotly contested s.423 trial.

What You Will Learn

This live and interactive course will cover the following:

  • The key components of a s.423 claim, and the important case law on each point
  • Tactical considerations for bringing/defending such claims
  • The likely effect of recent decisions of the Supreme Court and Court of Appeal

Recording of live sessions: Soon after the Learn Live session has taken place you will be able to go back and access the recording - should you wish to revisit the material discussed.
