Introduction

Deafness may be caused by many different processes - not all of which are tortious. This webinar will consider the evidence of fact, medical reports, limitation and quantum.

There will be consideration of how the case may proceed if it is brought more than three years after the date of injury and whether/how the Court will allow the claim to proceed pursuant to Section 33 of the Limitation Act 1980.

This webinar is recommended for those involved in bringing or defending claims brought by those who formerly served in the armed services and now suffer from deafness.

What You Will Learn

This short webinar will cover the following:

  • The ways in which deafness may be caused
  • Finding factual evidence to establish what has happened and why there may be a claim
  • Use of expert evidence to demonstrate the causation, condition and prognosis
  • Why limitation is often a problem
  • The factors which the court will consider if the claimant seeks to disapply limitation
  • The likely case management orders applying to the claim, including trials of preliminary issues
  • Schedule preparation and understanding the earnings/pension losses if the claimant has been deprived of a service career because of deafness

This pre-recorded webinar will be available to view from Friday 8th August 2025

Alternatively, you can gain access to this webinar and 1,700+ others via the MBL Webinar Subscription. Please email webinarsubscription@mblseminars.com for more details.
