Introduction

This webinar will consider the recoverability of damages for child claimants in the ‘lost years’ in light of the recent ‘leap-frog’ appeal to the Supreme Court in CCC v Sheffield Teaching Hospitals NHS Foundation Trust.

Since the Court of Appeal’s decision in Croke v Wiseman, child claimants have been unable to bring claims for damages arising in the ‘lost years’: where a child claimant’s life expectancy has been reduced by reason of the defendant’s negligence no damages for loss of income can be recovered in the period between the end of the claimant’s now shortened life expectancy, and his/her previously uninjured longer anticipated life-expectancy.

Whether the approach in Croke remains ‘good law’ and should continue to be followed and applied will be determined by the Supreme Court in CCC v Sheffield.
