Introduction

The rules concerning the terms contained in trader to consumer contracts are set out in the Consumer Rights Act 2015 and have been considered in several cases. However, there remains a considerable lack of knowledge among businesses about how to implement these rules in practice. Given that the Digital Markets, Competition and Consumers Act 2024 sets out fining powers of up to 10% of annual global turnover for serious breaches of consumer law, now is the time for lawyers and their clients to consider what changes need to be made to ensure compliance.

This virtual classroom seminar summarises the existing rules, outlines the proposed changes and sets out a series of practical steps to take.

What You Will Learn

This live broadcast will cover the following:

  • Successful incorporation of terms
  • Meaning of ‘reasonable steps to incorporate’
  • A summary of the ‘fairness’ test and the core terms exemption
  • The meaning of ‘prominent and transparent’
  • Examples of enforcement action taken by the Competition and Markets Authority
  • Details of the fining powers set out in the Digital Markets, Competition and Consumers Act 2024
