Fatal accident law is entirely a creature of statute and one that has been subject to significant criticism for many years. As a result, it is imperative that the procedural requirements of the statutory provisions are followed but, equally, the desire to balance the less palatable aspects of the legislation allow for broad application of principle by the court.
