Introduction

The Digital Markets, Competition and Consumers Act 2024 (‘the Act’) makes significant changes to consumer law that both lawyers and their clients need to be aware of.

In addition to changes to the rules on unfair commercial practices, the greatest change sees the introduction of fining powers both for the court and for the Competition and Markets Authority (‘CMA’) directly.

The changes will allow maximum potential fines to be levied of up to £300,000 or, if higher, up to 10% of the total value of the Trader’s turnover.
